NunuaLipa ("NunuaLipa", "we", "us", "our") provides cloud-based point-of-sale, inventory and business-management software at app.nunualipa.site (the "Service"). This document explains how we handle personal data and sets the rules for using the Service. By ticking the acceptance box when you register, or by logging in or otherwise using the Service, you confirm that you have read, understood and agree to it. If you do not agree, do not register or use the Service.

1. Who is responsible for what

You, the business owner who registers, are our customer. For the information you enter about your own customers, suppliers, staff and sales ("Business Data"), you decide what is collected and why. You are responsible for having a lawful basis to collect it and for informing the people concerned. We store and process Business Data on your behalf, only to provide the Service to you. For the personal data of account holders (such as your name and email), NunuaLipa is responsible as described in this document.

2. Information we collect

• Account information: your name, username, email address, phone number, business name, country, currency and timezone. Your password is stored only in hashed (irreversible) form.
• Business Data: products, stock, sales, purchases, expenses, customer and supplier details, staff accounts and the reports produced from them.
• Consent records: the date and time, your IP address and the version of this document that you accepted.
• Technical data: IP address, browser and device type, log data, and session and security cookies.
• Communications: messages you send us, and service emails we send you (registration, approval, password reset and security notices).

3. How we use information

• to create, review, approve, operate and secure your account and provide the Service;
• to communicate with you about your account and answer support requests;
• to detect and prevent fraud, abuse and unauthorised access, and to keep security logs;
• to maintain, fix and improve the Service;
• to comply with legal obligations and respond to lawful requests from authorities; and
• to keep proof that you accepted this document.

We do not sell your personal data, and we do not use Business Data for advertising.

4. Account approval

Registering does not automatically give you access. Every new account is reviewed and must be approved by NunuaLipa before you can log in. We may approve, reject, suspend or close any account at our discretion, including where information appears false or incomplete, or where the Service is used unlawfully.

5. Who we share information with

We share information only with: service providers who help us run the Service (such as hosting and email delivery) under appropriate confidentiality; public authorities where the law requires it; our professional advisers; and a successor if the Service is transferred to another owner. Staff accounts that you create can see Business Data according to the permissions you give them.

6. Cookies

We use essential cookies only: to keep you logged in, protect forms against forgery (CSRF) and remember your language. We do not use advertising cookies. If you block these cookies, logging in will not work.

7. How long we keep information

We keep account information and Business Data while your account exists and afterwards for as long as reasonably necessary for legal, tax, security and dispute-resolution purposes. You can ask us to delete your data (see section 10); we may keep what the law requires or allows us to keep.

8. Security

We use reasonable technical and organisational measures, such as encrypted connections, hashed passwords and access controls. No system is completely secure, and we cannot guarantee absolute security. You are responsible for keeping your login details confidential, choosing strong passwords and controlling what your staff can access. Tell us immediately at info@nunualipa.site if you suspect unauthorised access to your account.

9. Where data is processed

Our servers and service providers may be located outside Tanzania. By using the Service you understand that your data may be processed in other countries, with reasonable safeguards.

10. Your rights

Subject to applicable law, including the Personal Data Protection Act, 2022 of the United Republic of Tanzania, you may ask us to give you access to your personal data, correct it, delete it, restrict or object to its use, and you may withdraw consent at any time. You may also complain to the Personal Data Protection Commission. To exercise these rights, contact us using the details below. We may need to verify your identity first.

11. Age

The Service is for adults aged 18 or over. It is not intended for children.

12. Your responsibilities

• Provide accurate information and keep it up to date.
• Use the Service lawfully. You alone are responsible for complying with every law that applies to your business, including tax registration and receipting requirements, licensing, consumer protection, employment, and data protection towards your own customers and staff.
• You alone are responsible for the accuracy and completeness of the data you enter and for every decision you make based on the Service, its calculations or its reports. The Service is a tool. It is not accounting, tax or legal advice; consult a qualified professional where needed.
• Do not attempt unauthorised access, introduce harmful code, or use the Service for unlawful activity.
• Keep your own regular copies (exports) of records that matter to you. You are responsible for your own backups.

13. The Service is provided "as is"

To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any warranty of merchantability, fitness for a particular purpose, accuracy, or uninterrupted or error-free operation. We may change, suspend or discontinue any feature, or carry out maintenance, at any time. Features that are free today may change or become paid.

14. Limitation of liability

To the fullest extent permitted by law:

• NunuaLipa, its owners, staff and agents are not liable for any indirect, incidental, special, consequential or punitive loss, or for loss of profit, revenue, business, goodwill or data, or for business interruption, arising from or connected with your use of, or inability to use, the Service;
• we are not liable for loss or damage caused by your or your staff's acts or omissions, incorrect data entry, unauthorised use of your account (including through shared or weak passwords), your failure to keep backups, third-party services and infrastructure (such as internet, power, hosting or email providers), or events beyond our reasonable control; and
• our total liability for all claims connected with the Service is limited to the fees you actually paid us for the Service in the twelve (12) months before the event giving rise to the claim.

Nothing in this document excludes or limits any liability that cannot be excluded or limited by law.

15. Indemnity

You agree to indemnify and hold harmless NunuaLipa, its owners, staff and agents against any claim, loss, damage, liability or cost (including reasonable legal fees) arising from: your use of the Service; Business Data you enter, including any breach of another person's rights or of the law; your breach of this document; or the acts of the staff and users you create.

16. Your acknowledgement

By accepting this document you confirm that: you are at least 18 and have authority to bind the business you register; you have read and understood this document and have had the opportunity to obtain independent advice; you understand that NunuaLipa is a software tool and is not responsible for how you run your business or for any loss, damage, claim or dispute arising from your business activities, your customers, your staff or your use of the Service; and your acceptance is voluntary.

17. Suspension and ending

We may suspend or close an account for breach of this document, security or legal reasons, or misuse. You may stop using the Service and ask us to delete your account at any time.

18. Changes

We may update this document. The "last updated" date above will change, and we may notify you by email or on the login page. Continuing to use the Service after a change means you accept the updated document.

19. Governing law

This document is governed by the laws of the United Republic of Tanzania. We encourage you to contact us first so we can try to resolve any concern informally; the courts of Tanzania have jurisdiction over any dispute that cannot be resolved that way.
